Notary Public Services across England and Wales
Terms of Business
1. These terms must be read together with the letter from me, the Notary Public, confirming the terms of the instruction. Together they compromise the agreement between us.
2. By either returning to me a signed copy of my letter and the terms of business, advising me orally, by email, or continuing to instruct me after receiving a copy of the terms of business, you accept the terms and agree to be bound by them.
3. The acceptance of the Instruction and terms of business grants me, the Notary Public, the authority to deal with the documents for notarisation, preparation for legalisation and incur disbursements or expenses in relation to the instruction and engage with your instructing solicitors (should there be any appointed). You will be notified of any disbursement fees.
4. I, the Notary Public, will keep you informed and updated throughout each stage of the process and I, the Notary Public, will inform you upon any delays.
5. In addition to the Notary Public fees, you are responsible for all disbursements in relation to the instruction. I, the Notary Public reserve the right to request all fees upfront before proceeding to act on the Instruction.
6. I, the Notary Public, will inform you of any significant or substantial changes to the fees as soon as practicable.
Scope of Services
1. I, the Notary Public can authenticate and certify documents for use within the United Kingdom and Internationally.
2. Deal with the handling and preparing documentation for legalisation and consular legalisation, apostilles and in certain cases the drafting of documents (subject to further checks and documents).
3. Attend to the Witnessing of signatures and affixing the Notarial Seal by discretion and where appropriate.
4. Authenticating original documents ensuring they are true and accurate reproduction.

Documents and Identification
6. Copies of the documents you require Notarisation for will need to be provided to me, the Notary Public, together with any letter of instruction in relation to the required service before the appointment.
7. You will need to produce copies of the original documents at the appointment: (1) Valid passport and/or Driver’s License and (2) proof of address / Utility Bill / Bank statement.
8. I may ask for additional identification and other documents depending on the nature of the Transaction and whether the instruction is from an individual or a company. These documents could include (2) Company documents (2) Board Resolutions (3) Letter of Authority (4) Minutes of meetings (5) Foreign Identification (6) Marriage Certificate (7) evidence of identity of the authorised signatory.
9. The documents required for individuals differ to the documents required for Company’s and any such additional searches will be charged as an additional fee/disbursement which will be made known to you.
10. Where there has been a change of name, I may need you to produce evidence of such change, including marriage certificates, Birth Certificates, Divorce Decree’s, Decree showing change of name, Deed Poll and/or Statutory Declaration.
11. You are responsible for the information on the documentation, and any errors or omissions will be your sole responsibility and not that of the Notary Public whose job is to witness the relevant signature and affix the seal of office which will be done at my discretion, the Notary Public.
12. I, the Notary Public, do not accept responsibility for any delays, loss, omission, cost claims or damages arising out of the Notarisation of documents.
13. I, the Notary Public will not perform any Notary Services where there is a suspicion of any illegal or improper Act in relation to any Country.
Fees
14. All fees will be made known to you upfront before any charges are incurred, however, should circumstances change and further charges be incurred, you will be notified immediately.
15. My usual charges will be based off a fixed fee which will be made known to you based on the nature of the notarial act required.
16. I, the Notary Public, do not charge VAT therefore no VAT is included on this fixed fee and/or any of my fees.
17. Disbursements will be charged in addition to the fixed fee and can include but are not limited to, legalisation fees, postage fees, consular agent fees, courier fees, travel costs, translation fees and interpreter fees.
18. My minimum fee is £60.00 and should you meet the requirements for the same, you will be notified accordingly.
19. I do not accept cash payments over £200.00.
20. For matters that are complex in nature, I, the Notary Public fees will be charged according to my hourly rate of 300.00 per hour. No VAT will be included. The services included will be set out to you clearly and disbursements will be an additional cost to my notarial fees which I, the Notary Public, will inform you of accordingly.
21. I, the Notary Public, will send you A Bill and such bills are payable upon receipt. I, the Notary Public may request fees upfront, to cover the cost of the act and any disbursement charges.
22. You are responsible for ensuring you deposit any money into the correct bank account.

Legal Advice and Understanding of Documents
24. As a Notary Public I do not offer legal advice. You will need to take independent legal advice should you be seeking advice as to the transaction. I will only advise you in relation to the procedure of notarisation and the relevant formalities of such. You must take responsibility to understand the legal effect of the transaction.
25. If a document is in any language other than English, I, the Notary Public, must insist that a translation is obtained. If a translation is required, this will be charged at an additional fee. Any translation should include the translators name, address, qualification and the translator should provide the following statement: “Document X is a true and complete translation of Document Y, to which the translation is attached”.
26. I, the Notary Public, will not Notarise any documentation which is drafted in a language that I, the Notary Public, do not understand or for which there is no translation.
27. Should you and I, the Notary Public, not understand each other, it may be necessary to have an interpreter present and if this is required, this will be charged as an additional fee.
28. It may be necessary, in certain circumstances, for me, the Notary Public, to request a medical certificate to confirm your capacity.
Privacy, Data and Record Keeping

30. I, the Notary Public, am required to keep a record of the Notarial Act within my Notarial Register. This will be kept by me, the Notary Public, as a permanent record in a secure and electronic format.
31. No Data can be accessed externally and any data retained by me is only for the use of meeting my professional legal responsibilities as a Notary Public.
Insurance
32. I, the Notary Public, will at all times maintain professional indemnity insurance of at least 1,000,000.00 per claim.
Termination
33. You have the right to terminate your instruction with me, the Notary Public, at any time, but with reasonable notice.
34. Upon any termination of the Instruction, all fees, charges and disbursements will be charged accordingly and are expected to be paid in full.
35. The Consumer Cooling Off Cancellation Period – CCR 2013 (“CRR”) applies. This means that in these situations where the CRR applies, you will have a cancellation period of 14 days after the date of signature for the instruction to proceed or where continuing instructions have been received whichever is the earlier. Such cancellation provided you have given a clear statement, will allow me to reimburse you, no later than 14 days following the cancellation.
36. I, the Notary Public, have the right to terminate any instruction received by you if I, the Notary Public, have good reason to do so.
Other
37. You shall agree to indemnify the me, the Notary Public, against any losses, claims, demands, actions, liabilities, fines, penalties, reasonable expenses, damages and settlement amounts incurred by or in connection with the me as the Notary Public or the Notarial Service provided.
38. You accept the risk that sending any documents by email may not be fully secure and therefore accept the risk of a possible security breach.
The law between us shall be subject to English Law. You submit the exclusive jurisdiction of the English Courts when accepting this instruction.
